Arrant nonsense.

The persom suing for compensation sues the person responsible, and that 
person's insurer will take over the handling of the matter for the person 
insured.  Both legally and in practice, one sues the persom responsible, 
*not* the insurer.

You are plainly wrong.  Go on, admit it.
