How can the insurance company sell the car without your permission? They
do
not own it - you do. Even after it's been smashed it's still owned by you
and not the insurer, and even though the insurer can decide whether or not
the car will become a legal write-off (though you always have the right to
use an independent assessor), it's still owned by you!
Maybe in the US or elsewhere insurers claim to have the right to take
ownership of a pranged vehicle but that should NEVER happen here in
Australia.
